Mission Statement

    To accomplish the prompt and orderly disposition of the business of the court as required by law.

Department Description:

   The Clerk of the Superior Court, which the Arizona Constitution established as an elected official within each of the state's fifteen counties, serves as the official record keeper and financial officer of the Superior Court. Arizona Revised Statutes, Supreme Court and Local Court Rules clearly define the duties and functions of the Clerk of the Superior Court. These functions include, but are not limited to:

Administrator of Court Records and Exhibits

   All of the documents presented in a Superior Court case must be received, processed, secured and purged in accordance with certain statutory time constraints, archival standards and requirements. In this role the Clerk identifies the changing needs of various records management programs to ensure that the interest of the courts and the public are secured.

Fiduciary/Financial Officer of the Courts

   As the court's fiduciary officer, the Clerk receives, records, invests and disburses all statutory fees, fines, reimbursements, restitution and public/custodial trust funds, as ordered by the court; utilizing innovative systems and technologies whenever feasible. This flow of funds is accomplished only through court order and statutory authorization.

Judicial and Quasi-Judicial Officer

   The Clerk issues writs, subpoenas, wage assignments, and other court-related orders, serving in a quasi-judicial capacity. The Santa Cruz County Clerk of the Court has been appointed as the county's Probate Registrar and performs limited judicial functions in association with that appointment.  In accordance with A.R.S. 12-131, the Presiding Judge has appointed the Clerk as the Jury Commissioner for Santa Cruz County.

Ex-Officio Clerk of the Court

   The Clerk's presence at all court sessions is required by statute to receive and record court documents and exhibits, thereby establishing an independent record of court proceedings. In this role, the Clerk is responsible for ensuring proper documentation of court action as well as public access to court records.

Elected Departmental Administrator

   As the elected administrator of a court department, the Clerk has the responsibility to establish office policies, budgets, and procedures in accordance with the governing guidelines and policies of the Superior Court, the Supreme Court and Santa Cruz County.

                                                                  OVERPAYMENT  POLICY

Effective January 2, 2002, any checks or money orders received by our office for filing and/or payment fees that exceed  $10.00   of the scheduled payment owed, shall be  returned to sender, together with any documents sent.  A check or money order in the correct amount will be requested and postage and handling in the amount of $5.00 will be charged.

Any  overpayments up to the amount of  $10.00  will not be returned to payor and shall be receipted as an overpayment and transferred to the County's General Fund.

Please familiarize yourselves with our fee schedule (shown below).  Santa Cruz County does not have a Conciliation Court.  At this time, there are no additional local fees for filing.

(1) Pursuant to A.R.S. §12-284.01, assess a fee of no more than $15 on filing or appearance fees for the Document Storage and Retrieval Fund.

(2) Pursuant to A.R.S. § 12-284(E), in each county where the superior court has established a conciliation court, the petitioner and respondent shall pay an additional $65.

(3) Pursuant to A.R.S. § 12-284(C), assess a $15 surcharge on each post-adjudication petition filing in a domestic relations case for the Domestic Relations Education and Mediation Fund.

(4) Pursuant to A.R.S. § 25-504: Subsection M "...a fee shall not be charged to a person who files a request to terminate an order of assignment if an employer is making deductions on multiple assignments for an obligation for the same minor children." Subsection O "...a fee shall not be charged to a party filing a stipulation concerning satisfaction of support obligations."

(5) Pursuant to A.R.S. § 25-502(G), the party who petitioned for transfer must pay the post adjudication fee prescribed in A.R.S. § 12-284 to the county to which the proceeding is being transferred.

NOTE: Fee to convert an existing marriage to a covenant marriage - courts are advised to charge the $18 minimum clerk fee "Demand for notice, filing paper, or performing any act for which a specific fee is not provided by statute."
